The Blue Ginger $500 GIFTCARD Giveaway Sweepstakes Promotion ("Promotion" or "Sweepstakes") is sponsored by Blue Ginger – 111 Hana Highway, Kahului, HI 96732 The promotion is governed by these official rules. By participating in the Promotion, each entrant agrees to these official rules, including all eligibility requirements, and understands that the results of the Promotion are final in all respects. The Promotion is subject to all federal, state and local laws and regulations and is void where prohibited by law. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED.
Eligibility: Blue Ginger's $500 GIFTCARD Giveaway Sweepstakes Promotion (hereafter, “Promotion or Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old as of the date of entry. Employees, officers, directors, agents and representatives of Blue Ginger (hereafter, “Sponsor”), and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, consultants, advertising and promotion agencies (hereafter collectively, “Released Parties”) and each such individual’s immediate family members (spouse, parents, legal guardians, in-laws, grandparents, grandchildren, siblings and children, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. Void where prohibited by law. All applicable federal, state and local laws, regulations, and ordinances apply. By entering, you understand that you are providing your information to the Sponsor. The information you provide as detailed below will only be used for Sweepstakes purposes.
Promotion Period: Sweepstakes begins 6:01:00pm Eastern Time (“ET”) on 11/16/16 and ends 11:59:59 pm on 12/16/16 (“Promotion Period”).
HOW TO ENTER: To enter during the Promotion Period ("Entry")
Two (2) Ways to Enter during the Promotion Period:
Online method of entry: During the Promotion Period, complete the online survey and submit results at www.surveymonkey.com/r/BJCPRHT
All those that complete the online survey and submit results, located at this location, will be entered to win, assuming all other eligibility requirements have been met.
By mail: Write your full name, email address, complete mailing address, telephone number, including area code and date of birth on a 3X5" card and mail it in a stamped envelope to the Sponsor with ATTN: Blue Ginger Survey Sweepstakes. Entries must be postmarked during the Promotion Period and received no later than the date that is three days following the end of the Promotion Period (regardless of whether such final day to receive is a day on which mail is or is not delivered). Entries will not be acknowledged or returned. Proof of sending will not deem proof of receipt by Sponsor.
LIMIT ONE (1) ENTRY PER PERSON, REGARDLESS OF ENTRY METHOD USED. Multiple Entries are not permitted. If more than one Entry is received from one person, only the first Entry submitted will be considered valid, however any attempt by any entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, or logins, Entries through a sweepstakes club or similar entity, cheating, fraud, or any other unauthorized methods will void all entrant’s Entries and such entrant will be disqualified.
Submitting mass Entries generated by an automated program, script or macro or use of any other devices is prohibited and will result in disqualification. All Entries become the property of Sponsor and will not be acknowledged or returned.
General Conditions of Entry: No photocopied, facsimiled, e-mailed, mechanically reproduced or telephoned-in entries will be accepted. Receipt of entries will not be acknowledged, and proof of submission of an entry will not be deemed proof of receipt. Sponsor has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. Sponsor is not responsible for lost, late, invalid, unintelligible, incomplete, mutilated, garbled, postage-due or misdirected entries, which will be disqualified. All entries become the exclusive property of Sponsor and will not be returned. A person who enters this Promotion is explicitly consenting to receiving promotional information through email or otherwise from the Sponsor.
For the purposes of this Promotion and these official rules, "receipt" of an on-line entry occurs when Sponsor’s servers record the entry information upon clicking the "enter" or "submit" button at the bottom of the on-line entry form. Any automated computer receipt (such as a "thanks for entering message") does not constitute proof of actual receipt of an on-line entry by Sponsors. In the event of a dispute as to any on‑lineentry, the authorized account holder of the e-mail address used to register and submit the entry will be deemed to be the on-line entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
Winner Selection: One (1) potential Grand Prize winner will be selected in a random drawing from among all eligible entries received over the course of the Promotion Period. Drawing will be conducted by an independent consultant on or about 12/23/16. By entering, entrants agree to be bound by these Official Rules and to the decisions of the Sponsor, which will be final and binding in all respects. The potential winner will be notified by email and will be required to respond to Administrator within two (2) days of notification. The inability to contact the potential Grand Prize winner (as specified above), within the time specified above, or return of prize notification as non-deliverable may result in disqualification and, at Sponsor’s discretion, the awarding of the prize to an alternate potential winner in a random drawing from among all remaining entries. If Grand Prize winner is at least 18 years old but considered a minor in his/her jurisdiction of residence, the prize will be awarded in name of the parent/legal guardian of mior entrant whose entry is selected as the Grand Prize winner and such parent or legal guardian will be required to fulfill all requirements imposed on winners set forth herein and accompany minor as his/her guest. Odds of winning the prize depend upon the total number of eligible entries received.
Prize (1 Total): Grand Prize winner who will receive a $500 Gift card to blueginger.com and Blue Ginger retail locations. Odds of winning the Prize depend on the number of eligible entries received during the Promotion Period. Prizes are not transferable or refundable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by the Sponsor at its sole discretion. The winner is responsible for paying taxes and any and all other costs and expenses not listed above. (ARV of Grand Prize: $500.00/Total)
Except for the prize values, the prize winners will not receive any additional monetary compensation or acknowledgement for participation in the Promotion, any advertisement or other material. Except as specifically provided herein, each prize winner is solely responsible for all expenses and fees, including, without limitation, taxes, related to any prize or this Promotion. Reporting and payment of all applicable taxes resulting from acceptance or use of any prize are the sole responsibility of the winners.
Disputes/Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Hawaii, USA, without regard to its conflicts of laws principles.
